TERMS AND CONDITIONS OF SALE With acceptance of merchandise customer agrees to the following terms.
Liquidation, Clearance, Refurbished, PreSystems*, and Computer Affiliate Sales: Customer agrees to hold Aloha Computer harmless for any Loss, Damages, Warranty Claims, costs. Items are Sold as-is, No refunds or exchanges, warranty if any starts day of purchase and is provided by manufactures, Remanufacture,
Distributors or Affiliate Partners and not Aloha Computer. Credit card, Escrow and shipping fees are not refundable.
Payment: Invoices are due and payable in accordance with the terms listed on the front of this invoice. An interest of 2.0% per month will be added to past due accounts. A $25.00 NSF charge on all returned checks plus All legal court costs and service charges incurred in collecting payment will be an expense of and charged to the purchaser. Customer, not Aloha Computer & Software, is responsible for paying any state or local taxes.
DELIVERY: Unless otherwise noted delivery will be made from Aloha Computer & Software
or it's distributors facility with shipping charges to be paid by purchaser. Risk of loss passes to purchaser upon delivery by Aloha Computer & Software to common Carrier.
SOFTWARE SALES ARE FINAL All software sales are final. Aloha Computer & Software will not refund any money or exchange any software purchase. Aloha Computer & Software does not provide warranty or support for any software sold. Customer buys software on "AS-IS", manufacture may provide support if any. All custom built system sales are final. Aloha Computer & Software will not refund any money or exchange any customer ordered custom computer system.
RESTOCKING CHARGE 25% restocking fee, plus any additional incurred cost
on all items accepted for return. Hardware parts returned within 7 days may be bought back at lower of the price sold and current Aloha Computer & Software price. All returned items have to be in original package and items are sealed and not opened. No refunds on Items returned after 7 business days. Physically damaged parts, including cracks, pin missing, or burnt legs void refund, warranty or exchange policy. Special ordered items can not be returned or refunded.
LIMITED WARRANTY: Except as stated above, Warranty is not transferable. Aloha Computer & Software is not responsible for warranty to 3rd parties, only to original purchaser listed on the
sales receipt or invoice only.
Aloha Computer & Software Retail parts & Custom systems are warranted to be free from
hardware defects for 1 year from the day of the invoice or sales receipt.
(RMA) Please call for policy, Aloha Computer & Software reserves the right to hold returned products for up to 30 days for testing.
Products (hardware) that become defective during such period shall be tested for defect, then repaired or replace at
Manufactures, distributors, Aloha Computer & Software's option. The parts replaced may not be of the same type. Equivalent replacement will be done at
Manufactures, distributors, Aloha Computer & Software's option. This limited warranty is contingent upon proper use of the hardware products covered and does not cover hardware products which have been subject to unusual physical or electrical stress,
or POWER SURGES. A power surge suppressor should be installed , one that guarantees replacement of damaged components.
One year labor
warranty (hardware ONLY) on Custom systems if repairs are performed by Aloha Computer & Software, and system seals are not broken.
No SOFTWARE Support, Operating System support, Software SUPPORT or TUTORING is NOT Provided
but maybe obtained from third party service providers at customers expense. Labor warranty does not guarantee any preservation of any kind of data
or software in the computer. Aloha Computer & Software makes no warranties, either express or implied, with respect to connect speeds of modems. Connect speed of modems are dependent on the condition of the telephone lines in your
area. Any and all freight and handling charges for warranty or otherwise are the responsibility of customer and not Aloha Computer & Software. It is the customers responsibility to register any and all products for warranty or available extended warranty. If customer is installing a product it is their responsibility to contact tech support of the manufacture for proper installation instructions, and problem solving. Aloha Computer & Software is not responsible for damage or loss caused by Customer installed software, including
operating system (software) or hardware and voids warranty.
Aloha Computer & Software does not provide on site warranty repairs, all repairs must be made at address on front of this invoice, and is customers responsibility for any shipping or transportation charges made for warranty repairs. Aloha Computer & Software does not provide tutoring for the use or operation of any system or product, software or hardware sold. Aloha Computer & Software makes no other express or implied warranty with respect to hardware products other than the limited warranty referred to
above. All implied warranties including but not limited to implied warranties of merchantability and fitness for a particular purpose are hereby
excluded. The liability of Aloha Computer & Software, if any, for damages relating to any allegedly defective product shall under any legal theory be limited to actual price paid of such product and shall in no event include incidental or consequential damages of any kind, even if Aloha Computer & Software is notified of the possibility of such
damages. DISCLAIMER OF WARRANTIES ON ALL SOFTWARE Aloha Computer & Software makes no warranties, either express or implied, with respect to all software and accompanying manuals and materials, regardless of their source, their quality, performance, merchantability or fitness for any particular purpose. All such items are sold or licensed to purchaser by Aloha Computer & software on an "as is" basis. The entire risk as to their quality and performance is with the purchaser. Should such software prove defective following their purchase,
purchaser (and not Aloha Computer & Software or its suppliers) assume the entire cost of all necessary servicing, repair, or correction and any incidental or consequential damages resulting from any defect in such software, in no event will Aloha Computer & Software or its supplier be liable for direct, indirect, or incidental or consequential damages resulting from any defect in any software, even if Aloha Computer & Software has been advised of the possibility of such damages.
Warning: Customer installed software may VOID warranty. Operating System upgrade voids warranty.
Aloha Computer & Software, its hardware or software suppliers, makes no warranty, express or implied, concerning the applicability of any hardware or software to any specific purpose.
Aloha Computer & Software accepts no liability for loss or damages caused or alleged to be caused directly or indirectly by computer equipment or software sold by Aloha Computer & Software, including but not limited to any interruption of service, loss of business or anticipatory profits or special or consequential damages resulting from the use or operation of such computer equipment or computer software.
Aloha Computer & Software accepts no liability for loss of money from rebates not collected. .
SERVICE AGREEMENTS: All onsite service agreement contracts are made between
provider and the buyer, not Aloha Computer & Software. Customer, buyer agrees to hold Aloha Computer & Software harmless for any and all disputes arising out of the onsite service contract between customer and
Service Provider. Aloha Computer & Software does not provide onsite service. Customers may not have use of their computer while defective hardware is being
tested, repaired, or replaced. (see hardware, RMA above), Aloha Computer & Software reserves the right to hold returned products for up to 30 days for testing. Customer is responsible for all shipping costs of defective hardware, not Aloha Computer & Hardware.
USED, Refurbished, Reconditioned Laptop & Desktop Limited Warranty and Return Policy (not Factory Recertified or New) Limited Warranty, Only units that are covered. All others are sold AS-IS No Refunds, All Sales Final. (United States Only). Used / Reconditioned Laptop and Desktop computers. ("Used") Sold hardware products as used. The warranty term is 20-30 days (used 20day),(used Reconditioned, Remanufactured 30 day) beginning on the date of invoice, (not date received) and as further described below.
DELL, IBM Factory Recertified / Refurbished units have remainder of hardware warranty DIRECT from Manufacture or Remanufacture. Contact DELL or IBM support directly NOTE: Specifications, User Guide are provided for reference only. Refurbished units may not use same configuration and or Software as when sold new. Specifications may Change without notice. Media not included unless noted. This warranty does not cover damage due to external causes, including accident, abuse, misuse, problems with electrical power, servicing not authorized by Aloha Computer or it's distributors, usage not in accordance with product instructions, failure to perform required preventive maintenance, and problems caused by use of parts and components not supplied by Aloha Computer . This warranty will be voided if the user installed hardware or Upgrades the operating system other than what we ship, this includes Unix, Linux, and Windows 98, NT, 2000, Me, XP etc.
This warranty does not cover any items that are in one or more of the following categories: software; sound cards; speakers; batteries; internal modems; Network/LAN; external devices; accessories or parts added to a laptop computer after the system is shipped from Aloha Computer ; accessories or parts added to a laptop computer through Aloha Computer ; accessories or parts that are not installed in the Aloha Computer facility. Keyboard and pointing device that are included on Aloha Computer price list are covered under this warranty; however, the LCD Display devices not covered. There are no guarantees on the physical appearance . As a reseller of used, off lease, refurbished Factory Recertified computer equipment it is not unreasonable to expect minor physical flaws such as (but not limited to) small scratches, dents, misalignment, stains, stickers and/or tape or its residue.
To request warranty service, you must notify FAX, Email, Aloha Computer, Dell or IBM within the 30 day warranty period. If warranty service is required, Aloha Computer or it's distributors or affiliate partners will issue a RMA Number. You must ship the products back to Aloha Computer it's distributors or affiliate partners in their original packaging, prepay shipping charges, and insure the shipment or accept the risk of loss or damage during shipment. Aloha Computer or it's distributors will ship the repaired or replacement products to you freight prepaid if you use an address in the U.S. (excluding Puerto Rico and U.S. possessions). Shipments to other locations will be made freight collect. Any unauthorized RMA will not be accepted and will be returned/refused to the sender at his/her expense. All returned goods will be subject to a 25% re-stocking fee. A restocking charge (25%) and prepaid freight apply to all returns. Please note that a restocking charge may also apply if merchandise is returned without prior approval or the customer refuses shipment or is unavailable for delivery. We do not refund Shipping Charges. NO returns made after the 2 day Inspection Period. Notification MUST be made by Email or FAX, And you must receive a RMA # before the END of the 2nd day of inspection. Items sent freight collect will not be accepted and no credit will be given.
NOTE: Before you ship the product (s) to Aloha Computer or it's distributors, back up the data on the hard-disk drive (s) and any other storage device (s) in the product (s). Data loss is not covered under this warranty. Remove any removable media, such as diskettes, CDs, or PC Cards. If you have any questions, email Aloha Computer.
Aloha Computer or it's distributors owns all parts removed from repaired products. Aloha Computer or it's distributors uses new and reconditioned parts made by various manufacturers in performing warranty repairs and building replacement products. If Aloha Computer or it's distributors repairs or replaces a product, its warranty term is not extended.
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS WHICH VARY FROM STATE TO STATE (OR JURISDICTION TO JURISDICTION). Aloha Computer RESPONSIBILITY FOR MALFUNCTIONS AND DEFECTS IN HARDWARE IS LIMITED TO REPAIR AND REPLACEMENT AS SET FORTH IN THIS WARRANTY STATEMENT. ALL EXPRESS AND IMPLIED WARRANTIES FOR THE PRODUCT, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE WARRANTY PERIOD SET FORTH ABOVE AND NO WARRANTIES, WHETHER EXPRESS OR IMPLIED, WILL APPLY AFTER SUCH PERIOD. SOME STATES (OR JURISDICTIONS) DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
Aloha Computer or it's distributors DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH IN THIS WARRANTY STATEMENT OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION ANY LIABILITY FOR PRODUCTS NOT BEING AVAILABLE FOR USE OR FOR LOST DATA OR SOFTWARE. SOME STATES (OR JURISDICTIONS) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSION OR LIMITATION MAY NOT APPLY TO YOU.
Optional Extended Warranties: Aloha Computer does not provide warranty services. Extended warranty services are provided by independent service companies. Customer agrees to hold Aloha Computer harmless for any Loss, Damages, Warranty Claims, costs associated with any and all Warranties.
